User Agreement
Welcome to Global Matrix Survey ("GMS"). These Terms of Use ("Terms") outline the terms and conditions that apply to your interaction with our services.
1. Research Participation: These Terms govern your participation in surveys or studies conducted or facilitated by GMS.
2. Panel Membership: If you are a member of our survey panel (the "Panel"), these Terms also apply to your membership.
3. Website and Application Usage: Your use of https://www.globalmatrixsurvey.com/ or any other website or application where these Terms are posted, including our web application, constitutes your agreement to these Terms.
In this document, "Services" refer to Research, our website and web application, the Panel, and all associated services. Any reference to "GMS" is synonymous with Global Matrix Survey.
By registering for the Panel, using our Site, or participating in Research or other Services, you acknowledge and agree to the terms set forth in these Terms.
Global Matrix Survey reserves the right to modify these Terms, including additions or deletions, without prior notice. We will make reasonable efforts to notify our Panel members of any significant changes.
Your continued use of the Services after the publication of updated Terms indicates your acceptance of these changes.
Data Handling and Protection
Our Privacy Policy, available at https://www.globalmatrixsurvey.com/pages/privacy-policy/, is an integral part of these Terms. Please review it for more information on how we handle your data.
Additional Terms for Specific Services
Certain products, orders, or specific features of the Services may be subject to additional terms and conditions ("Additional Terms"). These Additional Terms are considered part of these Terms by reference. In the event of any conflict between these Terms and the Additional Terms, the Additional Terms will prevail.
Member Responsibilities
At Global Matrix Survey ("GMS"), we take member responsibilities seriously. We reserve the right to deny admission to our Panel or immediately terminate your Panel membership, with or without notice, for any violation of these Terms or any other reason within our sole discretion. By joining our Panel, you acknowledge and agree to the following without limitation:
1. Eligibility: You must possess a good understanding of English. To become a member of the Panel, you must be at least eighteen (18) years old. For participation in any Research, you must be at least 13 years old with parental consent when necessary. We may request age verification.
2. Verification: We may request verification of your identity and address before processing payments or orders, especially if fraudulent activity is suspected.
3. Single Account: Each individual may hold only one account. Offers should be registered under your own name, and each account should have only one user. While multiple accounts per household are allowed, other individuals must create their own accounts. We may request ID verification to confirm their identity. Access to certain sections of the website may be limited to one member per household.
4. IP Usage: Logging in from proxy IPs is prohibited. You can log in from cell phones and public internet connections (e.g., schools, Wi-Fi hotspots, libraries), but access to certain areas may be restricted. Playing games in a browser while connected to www.globalmatrixsurvey.com via a cell phone is not allowed. Requesting prizes or withdrawals from public locations is also not permitted.
5. Credit Card Usage: If you use a credit card for offers, it must be in your name and not someone else's.
6. Account Responsibility: You are solely responsible for the use of your GMS account and cannot authorize others to access it. All information provided during registration and offer completion must be your own and should not pertain to any other individual. Providing false information, including addresses, phone numbers, and names, is considered an attempt to commit fraud, and we reserve the right to suspend your account pending further investigation.
7. Internet Voicemail/Phone Numbers: The use of internet voicemail or internet phone numbers with your GMS account is not allowed.
8. Offer Completion: Repeating offers on GMS that you have already completed on other sites is not permitted. Generally, offers may be completed only once on GMS unless otherwise indicated. Categories that allow multiple completions include, but are not limited to, daily surveys, daily clicks, and recurring tasks.
9. Offer Cancellation: You are not permitted to cancel offers immediately after receiving credit, nor should you encourage others to do so. To qualify for credit, you must fulfill all offer requirements. Early cancellation or incorrect completion is considered fraud and may result in credit reversal or account suspension.
10. Confidential Information: You are not allowed to share or use any confidential information obtained through surveys. Unauthorized use of survey content may result in legal action.
11. Fraud Prevention: Fraudulent activities are not tolerated at GMS. We rely on the honesty of all parties to maintain the integrity of our community. We closely monitor our site for fraud and abuse to ensure a fair experience for all members.
12. Consequences of Fraud: Any instances of fraud, system abuse, or inappropriate or illegal activity detected may lead to account termination and potential legal action. All earnings, whether reversed by advertisers or not, will be revoked without warning, and any pending orders will be canceled.
13. Violation of Terms: Those found cheating, committing fraud, or otherwise violating these Terms will no longer be protected by them.
Prohibited Actions
At Global Matrix Survey ("GMS"), we have certain rules in place to ensure a safe and fair environment for all members. By using our services, you agree not to engage in any of the following activities:
1. Intellectual Property and Privacy: You must not post, communicate, or transmit any material that infringes on the intellectual property, publicity, or privacy rights of another individual or entity.
2. Legal Compliance: You should refrain from engaging in any conduct that may constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable law or regulation.
3. Network Security: Do not attempt to interfere with GMS' network security or use our services to gain unauthorized access to any other computer system.
4. Automated Data Mining: Using spiders, robots, or any other automated data mining techniques to catalog, download, store, or reproduce data or content related to our services is not allowed.
5. Survey Manipulation: It is prohibited to manipulate the results of any survey.
6. Privacy of Others: Do not collect any personal information of other users of our services.
7. Inappropriate Content: Posting or transmitting any threatening, libelous, defamatory, obscene, pornographic, lewd, scandalous, or inflammatory material or content that could violate applicable laws is strictly prohibited.
8. Fraudulent Activities: Engaging in any fraudulent activity is not tolerated. This includes actions such as rushing through surveys, attempting to complete the same survey multiple times, concealing or forging your identity, providing false information during registration, submitting fabricated or inaccurate survey data, or attempting to redeem rewards, prizes, or incentives through dishonest means.
Nature of Relationship
At Global Matrix Survey ("GMS"), it's essential to clarify the nature of our relationship:
1. Independent Contractors: You and GMS are independent contractors. These Terms do not establish a partnership, joint venture, agency, franchise, sales representative, or employment relationship between you and GMS.
2. Limited Authority: You understand that you do not have the authority to make or accept offers or represent GMS in any capacity. You must not make any statements, whether on your own website or otherwise, that would contradict the nature of this independent contractor relationship.
3. Tax Responsibility: You bear sole responsibility for reporting and paying any taxes on income earned while participating in the GMS program.
Ownership of Content
Global Matrix Survey ("GMS") respects intellectual property and proprietary rights. By using our Services, you acknowledge and agree to the following:
1. Property Rights: Content, materials, text, images, videos, graphics, trademarks, logos, button icons, music, software, and other elements available on our Services are the property of GMS, our licensors, or our clients. These are protected by copyright, trademark, and/or other proprietary rights and laws. You must not engage in the following activities: selling, licensing, renting, distributing, copying, reproducing, transmitting, publicly displaying, publicly performing, publishing, adapting, editing, modifying, or creating derivative works from any content or materials on our Services.
2. Confidential Information: Information and content made accessible to you through our Services may contain trade secrets or other confidential or proprietary information belonging to GMS, our clients, suppliers, or licensors. You must maintain strict confidentiality and refrain from disclosing such information to any other person. Sharing photographic or other imagery, information, or content from your activities related to our Services with third parties is prohibited. You must not use such information or content for any purpose other than your participation in our Services as outlined in these Terms.
3. Reporting Unauthorized Disclosure: You agree to promptly inform us if you become aware of or suspect any unauthorized use, disclosure, or access to any such information or content beyond what is expressly authorized by these Terms.
4. Copyrighted Material: No part of our Site, e-mails, newsletters, updates, templates, or promotions may be reproduced in any manner without our prior consent. This includes, but is not limited to, the use of GMS images, ideas, text, terms, or any other information we consider copyrighted material. Republishing, posting, or quoting part or all of such content online or offline through any means or method is strictly prohibited.
Earning Rewards
At Global Matrix Survey ("GMS"), we understand that you may have the opportunity to earn rewards through your participation in Research. Please be aware of the following:
1. Reward Discretion: We reserve the right to exercise discretion when granting rewards. This includes the right to refuse rewards for any reason within our sole discretion, such as instances of fraud, system abuse, or early termination. You should engage in surveys on a voluntary basis with the understanding that rewards are not guaranteed for the time spent completing offers.
2. Reward Verification: Points or other rewards will only be awarded after we have verified the completion of offers and received payment from the advertiser. GMS will not be considered obligated to make payment to any member. Delays in receiving commissions from advertisers may occur, and members participating in the GMS program acknowledge that no payment will be issued until GMS has received payment from its advertisers.
3. Responsibility for Redeemed Rewards: GMS is not responsible for rewards redeemed through Amazon or other merchants via our rewards gallery. Members should carefully review the product and seller information on Amazon before placing orders through our rewards gallery. We provide Amazon product links on all product pages in the rewards gallery.
4. Delivery Estimates: The estimated delivery date displayed on the orders page is a rough estimate based on our system's information and should not be considered a guaranteed delivery date. Members should refer to the product page on Amazon for specific delivery dates. In cases of item damage or delay, we will liaise with Amazon on your behalf. Refunds or exchanges will only be issued once this process is finalized with Amazon.
Email Communication
At Global Matrix Survey ("GMS"), we respect your inbox and have the following policies in place:
1. Site Updates and Newsletters: GMS may periodically send you emails containing information about site updates and maintenance. We only send these newsletters if you are subscribed to them. You can easily opt-out from these emails through your account management page or by clicking the unsubscribe link provided in any of the emails you receive.
2. Referral Links Promotion: You are prohibited from promoting your referral links through unsolicited emailing, newsgroup postings, or any other method of mass communication. Failure to comply with this policy will result in the immediate termination of your membership with GMS and may lead to legal consequences.
Fraudulent Activity
At Global Matrix Survey ("GMS"), we have a strict policy against fraudulent activity. Please be aware of the following:
1. Account Deletion: Using fraudulent information or engaging in offers with fraudulent intent will result in the immediate deletion of the member's account without prior notice. All funds in the account will be forfeited. Fraudulent activity includes, but is not limited to, the following: using stolen credit cards to complete offers, using false information, using information that does not belong to you, using prepaid gift or credit cards to complete offers, completing the same offer multiple times, and canceling offers or trials before receiving the product or service.
2. Multiple Signups: Multiple signups by a single individual member will lead to the immediate termination of all related accounts. GMS reserves the right to take legal action against individuals to recover any earnings received.
3. Anti-Cheat Measures: GMS has implemented a robust anti-cheat system to detect and prevent cheating. If a member is caught cheating or attempting to do so, we reserve the right to suspend their account, resulting in the forfeiture of all earnings.
Inactive Member Accounts
4. Membership and Inactivity: Membership at GMS is entirely free, with no charges for being a member or earning points. However, if your account becomes inactive, we reserve the right to terminate it. In such cases, any points or rewards you've earned may be forfeited. The determination of account inactivity and the forfeiture of points will be made at our sole discretion.
Disclaimer
At Global Matrix Survey ("GMS"), we want you to understand the following:
1. Use of Services: You assume all responsibility and risk when using our Services. The Services, along with all content, merchandise, and other information accessible from or through the Services or a linked site, are provided on an "as is" and "as available" basis. We do not provide any warranties, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, security, or accuracy.
2. No Guarantees: Specifically, but without limitation, GMS does not guarantee that:
- The information provided through the Services is correct, accurate, or reliable.
- The functions within the Services will be uninterrupted or error-free.
- Defects will be corrected.
- The Services or the servers that make them available are free of viruses or other harmful components.
Indemnification
3. Your Responsibility: You agree to indemnify, hold harmless, and defend Global Matrix Survey, including its parents, subsidiaries, divisions, and affiliates, as well as their respective officers, directors, employees, agents, and affiliates, from any and all claims, liabilities, damages, costs, and expenses related to your use of the Services, your violation of these Terms, content posted by you on the Services, or your violation of any law or the rights of a third party. This includes but is not limited to attorneys' fees incurred during the defense.
Limitation of Liability
At Global Matrix Survey ("GMS"), we want to clarify our liability limitations:
1. General Limitation: In no event shall Global Matrix Survey, its affiliates, or any of their respective officers, directors, employees, agents, successors, subsidiaries, suppliers, affiliates, or third parties providing information on the Services be liable to any user of the Services or any other person or entity for any direct, indirect, special, incidental, punitive, consequential, or exemplary damages. This includes, but is not limited to, damages for loss of profits, loss of data, or loss of use, arising out of the use or inability to use the Services, whether based upon warranty, contract, tort, or otherwise, even if Global Matrix Survey or any of the related parties mentioned above has been advised of or should have known of the possibility of such damages or losses.
2. Total Liability: In no event shall the total liability of Global Matrix Survey, its affiliates, or any of their respective officers, directors, employees, agents, successors, subsidiaries, suppliers, affiliates, or third parties providing information on the Services to you exceed the greater of:
- The total dollar value of all rewards you have accumulated in the twelve (12) months preceding the dispute.
- One hundred and fifty dollars ($150).
3. Time Limit for Claims: Any claim or cause of action arising from the use of the Services or these Terms must be filed within one (1) year after such claim or cause of action arises.
4. Survival: The provisions of this section will continue to apply even after the termination or expiration of these Terms.
Non-Liability
At Global Matrix Survey ("GMS"), we emphasize the following points regarding liability:
1. Independent Use: GMS will not be liable for any consequences resulting from your independent use of your account. You acknowledge and agree that your participation in the Panel and any Research is voluntary, and you are solely responsible for your actions. GMS will also bear no responsibility for its legal actions concerning your account, including suspension or termination. Furthermore, GMS does not ensure or endorse products or services advertised on the platform or discussed in Research. Members are solely responsible for the consequences of decisions made in relation to partner websites.
Dispute Resolution
2. Governing Law: All disputes arising under these Terms will be governed by and interpreted in accordance with the laws of Florida, without regard to principles of conflict of laws.
3. Arbitration: The parties to these Terms will submit all disputes arising under this agreement to arbitration in Orlando, Florida, before a single arbitrator of the American Arbitration Association ("AAA"). The arbitrator will be selected in accordance with the rules of the AAA or by mutual agreement of the parties, provided that the arbitrator is an attorney admitted to practice law in Florida. No party to these Terms will challenge the jurisdiction or venue provisions as provided in this section.
4. Injunction: Nothing contained herein shall prevent a party from seeking an injunction.
Class Action Waiver
5. Individual Dispute Resolution: Any arbitration or court trial related to a claim under these Terms will occur on an individual basis, without resorting to any form of class or representative action. This Class Action Waiver precludes any party from participating in or being represented in any class or representative action regarding a claim under these Terms.
Termination
6. Termination and New Accounts: Termination of a member's account results in the forfeiture of the privilege to create a new account. Only one account per individual is allowed. The creation of multiple accounts for the same individual is considered fraud, and both accounts will be deleted with all funds forfeited.
7. Account Information: Members must use accurate and up-to-date account information. Inaccurate or false account information may lead to account termination without notice. Members may cancel their use of GMS at any time by submitting a support ticket. Terminated accounts lose all potential benefits associated with the site, including earned points and requested prizes. GMS will not owe anything to members with terminated and/or suspended accounts.
8. Fraudulent Activity: GMS reserves the right to terminate accounts and withhold orders from members found to have fraudulently completed offers, regardless of the degree of fraud.
